We’ve had some folks worried that SB1090 would stop them from building an ADU as part of their rebuild. We want to be clear: the passage of SB 1090 will not stop a homeowner from adding an ADU to their single family lot!
The ADU ordinance, the SB 9 (“duplex”) ordinance, and the SB 1123 (“townhouse”) ordinance are three separate pieces of legislation.
The ADU ordinance allows up to 3 units on a single family lot:
- A main residence,
- An attached or detached ADU (up to 1200 sq ft), and
- An attached JADU (up to 500 sq ft)
The ADU ordinance does interact in various ways with the SB 9 and SB 1123 ordinances, but that interaction is not relevant to SB 1090. The proposed SB 1090 will not affect your right to build an ADU or JADU on your lot.
